Follow up: Whatsapp Cease and Desist FULL LETTER + self-help group discord invitation Posted: 02 Jul 2018 10:57 AM PDT Many of you have seen: https://www.reddit.com/r/Android/comments/8v9pb4/whatsapp_sent_me_a_cease_and_desist_letter_for/ I know of 3 different people who have gotten the exact same letter so I will be posting its contents at the bottom of the post for all the people who are interested in what it says. Yesterday's OP thought only he'd receive the email but there is a lot more of us. The reason why I've made this post is because I would like to invite you to join a discord where we can discuss details. The discord will help everyone not wanting to reveal their identity to stay anonymous. For most of the times I love reddit for how it works but it's not the right place to discuss it here - /r/legaladvice talks about law, /r/androiddev talks about API's but there is no place to have a chat and build a small community around this issue. Also, iOS apps have been addressed as well but this sub has given this topic the most traction so I hope it's ok to post about it here again. If you don't like the idea that's fine but I think sticking together might help us (otherwise competing) devs to address this. And, as promised, the original letter which is the exact duplicate of what everyone is getting. I have changed a bit in e.g. formatting and spelling because there might be differences that I haven't spotted but most of the text is untouched: $GREETING, We represent WhatsApp Inc (WhatsApp). We write you to provide notice that your operation of $APP_NAME+[FOOTNOTE1] ('Your Service') violates Whatsapp's legal rights and must be discontinued immediately and permanently. Specifically, you charge $CURRENCY $AMOUNT for Your Service and advertise it as follows: $APP_DESCRIPTION Pursuant to WhatsApp's Terms of Service, you are prohibited from using (or assisting others in using) WhatsApp's apps, services, features, software, or website (the "WhatsApp Services") in ways that: * > Violate, misappropriate, or infringe the rights of WhatsApp or its users, including privacy, publicity, intellectual property, or other proprietary rights; or In addition, you must not (or assist others to) access, use, copy, adapt, modify, prepare derivative works based upon, distribute, transfer, display, perform, or otherwise exploit the WhatsApp Services in impermissible or unauthorized manners, or in ways that burden, impair, or harm "WhatsApp", the "WhatsApp Services" or systems, or WhatsApp's users, including (as relevant here) that you must not directly or through automated means:
By way of non-exhaustive example, Your Service violates each of the above provisions. You agreed to these Terms of Service by installing, accessing, or using the WhatsApp Services. WhatsApp demands that you immediately cease all development, distribution, promotion, operation, sale, and offering of Your Service at all distribution points – including websites and social media accounts – and confirm you will not in the future develop, distribute, promote, operate, sell, and/or offer Your Service or any like code, products, services, or resources. We request that you notify us of your compliance within $UNDERLINEseven days$/UNDERLINE of the date of this letter by responding to this e-mail. To avoid confusion, WhatsApp hereby revokes your limited license to access the WhatsApp Services for any reason whatsoever. This means that you, your agents, employees, affiliates, or anyone acting on your behalf (collectively, "Your Parties") shall not access the WhatsApp Services for any reason whatsoever. Any activity by Your Parties on the WhatsApp Services is intentional and unauthorized access to the WhatsApp Services and systems. This letter is not a complete list of all of WhatsApp's rights you may have violated. This letter is not intended by WhatsApp, and should not be construed by you, to be a waiver, relinquishment, or limitation of any other rights and remedies that WhatsApp may have against you in this or any other matter. WhatsApp specifically reserves all such rights and remedies, whether at law or in equity, under applicable laws (including domestic and foreign laws). Finally, please note that you are legally required to preserve all documents, tangible things, and electronically stored information in any way connected to the issues addressed in this letter. We look forward to hearing from you. [link] [comments]

It looks like Digital Wellness won't come out till 9.1/Fall? Posted: 02 Jul 2018 11:00 AM PDT https://plus.google.com/+AndreasProschofsky/posts/RGnqGZmGp2p According to Andreas Proschofsky: I actually asked that question to Google's Dave Burke at I/O (and mentioned the answer in one of my articles). The whole digital wellbeing stuff won't be in 9.0 for current devices. This is stuff for fall, so I would guess they will debut it with the Pixel 3. [link] [comments]

Google Says It Doesn't Go Through Your Inbox Anymore, But It Lets Other Apps Do It Posted: 02 Jul 2018 10:07 PM PDT

Posted: 02 Jul 2018 07:32 AM PDT It isn't mentioned in the release notes so I'm not sure exactly when it happened – it may only be in the beta at the moment – but I just noticed the option was available. [link] [comments] |
